Article 1 Definitions

In this Privacy Statement the following concepts are indicated with a capital letter. These concepts have the following meanings.

  2. Personal data: every piece of data with which the Data Subject can be directly or indirectly identified or is identifiable.

  2. SOLVUS: a trade name of USG People Business Solutions Ltd.

Training Course: a meeting arranged by USG People Business Solutions Ltd (SOLVUS) or by order of USG People Business Solutions Ltd (SOLVUS) for the purpose of transmitting knowledge and/or skills. A Training Course can also be designated as (inter alia) training, workshop, seminar, theme day and/or course.
  3. Principal: the natural person who or legal entity which gave USG People Business Solutions Ltd (SOLVUS) an assignment or entered into an assignment contract with USG People Business Solutions Ltd (SOLVUS) in the areas of employment mediation, the provision of labour capacity and/or the execution of projects (whether or not by third parties), this in the broadest sense of the term.
  4. Processor: companies and/or persons who are called upon by USG People Business Solutions Ltd (SOLVUS) for the performance of specific tasks.
  5. Profile: the Profile of the Data Subject with data concerning the training course(s) taken by him and his (work) experience as well as all other data relevant for employment mediation, the provision of labour capacity and/or the execution of projects.
  6. Website: the website www.solvus.be operated by USG People Business Solutions Ltd (SOLVUS).
  7. Portal:a protected part on the Website(s) of USG People Business Solutions Ltd (SOLVUS) to which access can only be obtained with the aid of a user name and password allocated by USG People Business Solutions Ltd (SOLVUS). A Portal is also designated as a personal account.
  8. Community Network: the protected social network on the Website(s) of USG People Business Solutions Ltd (SOLVUS) which can only be accessed with the aid of a user name and password allocated by USG People Business Solutions Ltd (SOLVUS).
  9. CPP: Commission for the Protection of Privacy, the national supervisory authority on compliance with the laws in Belgium that regulate the use of personal data.

Words in the singular also include the plural and vice versa. Where he/him appears must also be read as being she/her.

Article 2 Applicability

  1. This Privacy Statement applies to the registration and processing of all Personal Data which the Data Subject provides in any way to USG people Business Solutions Ltd (SOLVUS).
  2. USG People Business Solutions Ltd (SOLVUS) attaches the greatest importance to the privacy of the Data Subject who provides Personal Data to USG People Business Solutions Ltd (SOLVUS). It shall use all Personal Data provided to it by the Data Subject solely for the purposes described in this Privacy Statement and shall comply with the applicable laws and regulations concerning the protection of Personal Data.
  3. In so far as the processing of Personal Data on the basis of the applicable rules must be reported to the Commission for the Protection of Privacy, a declaration will be made in the name of USG People Business Solutions Ltd (SOLVUS). This declaration can then be consulted in the public register that is accessible on the website of the CPP:http://www.privacycommission.be.

Article 3 Provided Personal Data

In order to be able to make use of the services of USG People Business Solutions Ltd  (SOLVUS), the Data Subject must provide the Personal Data necessary for the activities/services of USG People Business Solutions Ltd (SOLVUS).

Article 4 Purposes of use

  1. The Personal Data provided to USG People Business Solutions Ltd (SOLVUS) by the Data Subject are processed for the purpose of:
    1. being able to carry out and manage the registration /application of the Data Subject;

    6. being able to offer the Data Subject work, assignments, Training Courses and/or educational possibilities, career and/or professional advice and/or other (work-related) services;
    7. assessing the suitability of the Data Subject for a specific position or assignment;
    8. being able to allow the Data Subject to participate in (online) tests offered by USG People Business Solutions Ltd (SOLVUS) and generating test results;
    9. promoting and stimulating the personal development of the Data Subject (if and in so far as the Data Subject qualifies for this);
    10. bringing the Data Subject into contact with or introducing him to one or more Principals and/or relations of USG People Business Solutions Ltd (SOLVUS);
    11. having the Data Subject perform activities, services and/or projects at Principals and/or relations of USG People Business Solutions Ltd (SOLVUS);
    12. informing the Data Subject about similar products and/or services of USG People Business Solutions Ltd (SOLVUS);
    13. informing the Data Subject about matters which, in the judgement of USG People Business Solutions Ltd (SOLVUS), are of importance for the Data Subject (including (new) job openings, training courses organised by USG People Business Solutions Ltd (SOLVUS), work-related matters, etc.);
    14. informing the Data Subject about and/or warning him against improper use and/or abuse of its Website;
    15. informing third parties about and/or warning them against the improper use and/or abuse by the Data Subject of the Website of USG People Business Solutions Ltd (SOLVUS), in so far as this is necessary in order to counter and/or limit such improper use or abuse;
    16. providing them to Processors who are called upon by USG People Business Solutions Ltd (SOLVUS) for the performance of specific tasks;
    17. analysing the job market and their own files with Data Subjects;
    18. informing the Data Subject about the products and/or services of partners that are carefully selected by USG People Business Solutions Ltd (SOLVUS) by placing information about them on its Website;
    19. using them and passing them on to Principals,  relations and subcontractors of USG People Business Solutions Ltd (SOLVUS) and to government agencies;
    20. providing them to the group companies affiliated with USG People Business Solutions Ltd (SOLVUS) within the group of USG People Business Solutions Ltd (SOLVUS), entailing that the data of the Data Subject may (also) be included in the database of these affiliated group companies.

By registering with USG People Business Solutions Ltd (SOLVUS), the Data Subject grants to USG People Business Solutions Ltd (SOLVUS) the right to use the data provided upon his registration for the above-mentioned purposes, in so far as this is in line with the relationship between the Data Subject and USG People Business Solutions Ltd (SOLVUS).
  3. The Data Subject can be offered the possibility to indicate that his Personal Data may also be used to inform him by e-mail, SMS or any other electronic means of communication about products and services, not identical or similar to the services provided by USG People Business Solutions Ltd (SOLVUS), including the products and services of partners that are carefully selected by USG People Business Solutions Ltd (SOLVUS). The Data Subject can revoke the permission granted by him at any time by sending an e-mail to info@solvus.be.

If the data of the Data Subject are used by USG People Business Solutions Ltd (SOLVUS) to inform the Data Subject by e-mail, SMS or any other electronic means of communication about the similar products and services offered by USG People Business Solutions Ltd (SOLVUS), the Data Subject can object to this at any time by sending an e-mail to info@solvus.be demanding that his data no longer be used for this purpose.
  5. If the data is provided to the group companies affiliated with USG People Business Solutions Ltd (SOLVUS), as a result of which the data of the Data Subject are (also) included in the database of these group companies, then this Privacy Statement also applies with regard to the processing of the data of the Data Subject by these group companies. All of this with it being understood that the name of the relevant group company must be read wherever USG People Business Solutions Ltd (SOLVUS) appears in this Privacy Statement.

Article 5 Provision of data to third parties / public disclosure of data

  1. USG People Business Solutions Ltd (SOLVUS) shall not provide any Personal Data of the Data Subject to third parties, unless and in so far as:
    1. this is indicated as such in this Privacy Statement;
    2. USG People Business Solutions Ltd (SOLVUS) is authorised and/or is obliged to do so on the basis of the law and/or regulations, or is asked to do so by a government institution or other regulatory authority;
    3. in the judgement of USG People Business Solutions Ltd (SOLVUS) this is necessary to protect its rights and/or property (including that of the group companies affiliated with it), or to prevent a criminal offence and/or to protect state security or the security of its Applicants and Employees;
    4. this is done to verify the completeness and correctness of the provided Personal Data.

If the data of the Data Subject, whether or not via USG People Business Solutions Ltd (SOLVUS), are provided to a Processor, then this Processor only receives access to the Personal Data of the Data Subject if it is strictly necessary in order to perform the tasks assigned by USG People Business Solutions Ltd  (SOLVUS). USG People Business Solutions Ltd (SOLVUS) obliges the Processor called upon by it not to provide to third parties or to use the Personal Data of the Data Subject for any purpose other than that for which these data are obtained. Article 6 Processing of sensitive Personal Data

Article 7 Security and liability for third parties

Article 8 Liability

  1. USG People Business Solutions Ltd (SOLVUS) ‘s liability for indirect harm is excluded in all cases.
  2. Any potential liability is limited to a maximum amount of € 2,500 per event and a maximum of € 5,000 per calendar year.
  3. Furthermore, the liability of USG People Business Solutions Ltd (SOLVUS) shall under no circumstances ever amount to more than what is paid by its insurance in the case in question.

 

 

Article 9 Right of inspection
